Electronic Employment Record Books
From 1 January 2021, employers will no longer be able to provide employees hired for the first time with a paper employment record book.

FINES RELATED TO REPORTS ON
From 1 January 2021, the Pension Fund of the Russian Federation will start imposing fines for failure to submit in due time or submission of incomplete/inaccurate information on employment history of employees. Liability is established by Article 15.33.2 of the Code of Administrative Offences of the Russian Federation, which entails the imposition of an administrative fine in the amount from RUB 300 to RUB 500 on officers only.
Article 15.33.2 of the Code of Administrative Offenses of the Russian Federation was supplemented with Part 2, which provides for liability for a failure to submit in due time or submission of incomplete and/or untrue employment history of employees to the Pension Fund of Russia according to the Law on Personified Accounting. Liability for such act is established for officers only, in the form of a fine in the amount of RUB 300 to RUB 500.
The deadlines for submitting the report with the employment history of the registered person (SZV-TD) to the Pension Fund of the Russian Federation are as follows:

in case of transfer to another permanent job, when the registered person files an application for further record-keeping of his/her work record book by the insurant in accordance with Article 66 of the Labor Code of the Russian Federation or for provision of the employment records by the insurance in accordance with Article 66.1 of the Labor Code o/f the Russian Federation - on or before the 15th day of the month following the month in such the employee was transferred to another job or filed an application;
-
in case of employment and dismissal of the registered person - on or before the business day following the issue date of the respective order, other decisions or documents attesting formalization of employment relations.
Subclause 2, Clause 2.5 of Article 11 of Federal Law No. 27-FZ dated April 1, 1996 “On Individual (Personified) Accounting in the System of Compulsory Pension Insurance” - from January 1, 2021.
List of industries, jobs and positions with harmful and/or hazardous labour conditions, where women’s employment is restricted
From 1 January 2021, a new list of industries, jobs and positions with harmful and/or hazardous labour conditions, where the employment of women is restricted, will apply.
The list of the Ministry of Labor will supersede the list approved by RF Government Decree No. 162 dated February 25, 2000.
The list was cut almost five-fold, but in fact more than a half of the previous jobs were left.

Distant (Remote) Work
Chapter 49.1. of the Labor Code of the Russian Federation governing labor of distance employees was amended and supplemented.

Now remote work has become a synonym of distance work.

Starting January 1, 2021, an employment agreement concluded for distance work may be either permanent or temporary.

Distance work may be alternated with work at the work place.

In case of emergency, employees may be transferred to remote work without their consent.

The interaction between the employer and the distance worker is settled.

Additional grounds for the dismissal of distance workers are changed.
The amendments will come into force on January 1, 2021.

New notification forms related to the employment of foreign nationals in the Russian Federation
From 1 January 2021, new notification forms related to the employment of foreign nationals in the Russian Federation sent to the internal affairs authorities by the employer will apply.

The schedule for transfer of holidays in 2021 has been approved:

Changes in STD-PFR certificate
The STD-PFR certificate is issued to the employees by the Pension Fund of the Russian Federation and contains their employment history. The Pension Fund of the Russian Federation started record-keeping of so-called electronic work record books from January 1, 2020.
Starting December 14, 2020, the STD-PFR certificate may include information on the length of employee’s service before December 31, 2019. If an employee wants this information to be included in the electronic work record book, the employee shall submit it personally to the territorial division of the Pension Fund of the Russian Federation.

Changes in 2021 under discussion
Draft Federal Law No. 1021580-7 On Amending Articles 1 and 2 of the Federal Law On the Minimum Statutory Wage (Regarding the Establishment of a Minimum Hourly Wage to Calculate Employee’s Remuneration When Signing a Fixed-Term Part-Time Employment Contract)
An hourly minimum wage is proposed in Russia, but only for part-time workers.
