On October 19, 2021, the Mayor of Moscow amended his decree of June 8, 2020 No. 68-UM, establishing a regime of restrictions and regulating, among other things, the procedure for organizing work processes for employers in Moscow.
In the period from October 25, 2021 to February 25, 2022, employers operating in Moscow are required to:
1. To transfer to remote work:
- at least 30 percent of company’s employees, including performers under civil law contracts,
- all employees aged 60 and over,
- employees with chronic diseases.
2. On weekly basis, to submit information about employees and performers under civil law contracts, who were transferred to remote work.
The requirement to transfer employees to remote work does not cover the following organizations:
- continuously operating organizations and production;
- medical and pharmacy organizations;
- organizations that provide the population with food and basic consumer goods;
- organizations that perform urgent work in an emergency situation and in other cases that endanger life, health or normal living conditions of the population;
- organizations that carry out urgent repair and loading and unloading operations;
- organizations that provide financial services in terms of urgent functions - primarily services of settlements and payments.
The requirement of transfer to remote work does not refer to the employees:
- who received a second coronavirus vaccine or a single-component vaccine,
- who had a coronavirus infection and no more than 6 calendar months have passed since the date of their recovery, if information about this is available in UMIAS or the Unified State Health Information System.
- whose presence at workplaces is critical for the operation of the organization.
How to calculate 30% of employees who should be transferred to remote work
30 percent should be calculated from the total number of employees, including performers under civil law contracts, who actually work on the territory of Moscow.
When determining the number of employees who should be transferred to remote work, the following employees are excluded from the calculation:
- employees whose place of work is not Moscow, but another region;
- vaccinated employees;
- employees who have had a coronavirus infection, and no more than 6 months have passed since the date of their recovery.
The remaining number of employees and performers under civil law contracts is multiplied by 30%. This gives the number of employees who must work remotely. This number may include remote workers with whom previously employment contracts on remote work were concluded and whose place of work is Moscow, as well as employees on vacation. The main thing is to comply with the requirement not to exceed 70% of employees who are at the same time at work.
If employees aged 60 and over, as well as employees with chronic diseases, cannot be transferred to remote work due to the specifics of their jobs, then such persons should get sick lists.
It is possible to transfer employees temporarily to remote work unilaterally. It is not required to conclude additional agreements to employment contracts; it is enough to issue a local regulatory act on temporary transfer.
Starting from October 25, 2020, every Monday, organizations must submit information about employees transferred to remote work to the Moscow government in electronic form through the employer's personal account on the website of the Mayor and government of Moscow. If after the submission of the first report on October 25, the composition of employees who were transferred to remote work or information about them does not change, then there is no need to submit a report every week. If the number of employees has changed or information about them has changed, then you need to submit a report on the day the changes occurred.
Information must be provided in the approved form (Appendix 4 to the Decree of the Mayor of Moscow dated March 5, 2020 No. 12-UM).
Information about employees who are subject to transfer to remote work includes:
- Mobile phone number;
- Vehicle number (if any);
- Number of the electronic card "Troika";
- Number of the electronic card "Strelka";
- Social card number;
- Number of a monthly pass without travel limit and with a limit of 70 trips, a temporary unified social or discount ticket.

We recommend that you start collecting information and filling out the form in advance, so that on October 25, 2021, you could submit it to the Moscow government in time.
Employers who do not submit the report or provide false information face a warning or a fine in accordance with article 20.6.1 of the Administrative Offences Code of the Russian Federation. For officials, the fine is from 10 000 to 50 000 rubles, for legal entities - from 100 000 to 300 000 rubles.
In the event of a repeated violation, as well as in the event that the violation entails harm to human health or property, the fine for the organization will be from 500 000 to 1 000 000 rubles or administrative suspension of activities for up to ninety days.
