An electronic employment record book is a new format of employment record book being familiar to everyone.
By now, three bills related to transition to electronic employment record books have been drafted:
• on amending the Labour Code of the Russian Federation (as regards compiling employment history in electronic form) (the draft law has been passed in its first reading, the expected date of putting it into effect is 1 January 2020);
• on amending the Federal Law “On Individual (Personalised) Record-Keeping in the Compulsory Pension Insurance System” (the draft law has been passed in its first reading, the expected date of putting it into effect is 1 January 2020);
• on amending the Russian Federation Administrative Offence Code as regards introducing administrative liability for employer’s failure to comply with the time limit to provide employment history or for providing incomplete and/or false information in the history (the draft law is under consideration).
The process of transition to electronic employment record books will take place on a staged basis:
During 2020, an employer will have to take a number of actions:
• make amendments to the existing local regulatory acts as regards documents to be submitted when entering employment and employers’ duty to provide employment history of employees;
• install or update software for sending a new report on employees’ employment history to the Pension Fund of Russia, the information will be filed within the existing format of the company interaction with the Pension Fund authorities (Kontur, Taxcom, etc.).
• inform employees in writing of the changes in the labour legislation that are related to keeping the employee’s employment history in electronic form, including the right to have the employment history kept on paper at the employee’s request, in addition to the electronic format.
After January 2021, the employer must:
• return paper employment record books to those employees who have not expressed their wish to continue having them kept and continue keeping them for those who have decided to leave them.
• issue, at an employee’s request, his/her employment history within three working days in hard copy or in electronic form (as selected) and, in case of dismissal, in hard copy with an official’s signature or in electronic form with an enhanced qualified digital signature.
• send, to the Pension Fund of Russia, information on hiring, transfer, dismissal on or before the following working day after issuance of a document being the basis for hiring or dismissal
• keep employment history in electronic form for employees getting their first job, as from 1 January 2021.
