A paid working day for employees’ medical examination 

From 11 August 2020, amendments to the Russian Labour Code came into force, entitling employees aged 40 and over to an annual exemption from work to undergo medical examination. 

Before the amendments came into force, employers had provided an exemption from work for employees aged 40 and over to undergo medical examination once in three years. 

Other employees are also entitled to be exempt from work to undergo medical examination, but at different intervals. The changes only apply to employees aged 40 and over who are below pre-retirement and retirement age.

Guarantees for the employees dismissed due to company liquidation or personnel reduction 

On 13 August 2020, amendments were made to the Labour Code of the Russian Federation concerning the procedure, terms and amounts of payments to employees dismissed due to personnel reduction or downsizing or company liquidation. 

The said changes affect Articles 178 and 318 of the Russian Labour Code:

  1. The Employer may now replace the payment of the monthly average wages for the employment period with the payment of a lump sum of the two-month average wages immediately on dismissal. 

  2. The time frame stipulated for employees to claim their average monthly wages from their former employer is 15 working days after the end of the month in which the employee was not employed after dismissal. 

  3. The time frame within which the Employer will have to pay the average monthly wages is set at 15 calendar days. 

  4. The company is now not allowed to complete the liquidation procedure until it has paid the employees all amounts payable as a result of the dismissal due to the company liquidation.

Electronic Employment Record Books: Amendments to Certain Legal Acts

Due to the introduction of electronic employment record books, amendments have been made to 23 legal acts. These include: 

  • Federal Law On Employment of the Population in the Russian Federation 

  • Federal Law On the Prosecutor’s Office of the Russian Federation 

  • Federal Law On the Status of Judges in the Russian Federation Penal Code of the Russian Federation 

  • Federal Law On Compulsory Social Insurance Against Industrial Accidents and Occupational Diseases

  • Federal Law On State Registration of Legal Entities and Individual Entrepreneurs 

  • Federal Law On the Legal Status of Foreign Nationals in the Russian Federation

Federal Law No. 268-FZ dated 31 July 2020 On the Amendments to Certain Legal Acts of the Russian Federation
