ELECTRONIC EMPLOYMENT RECORD BOOKS

Starting 01 January 2020, transition to electronic employment record books was launched. New Article 66.1 has been added to the Labour Code of the Russian Federation titled «Employment History Records».

Over the course of 2020, the employed will have to choose the method for compiling employment records: either a paper-based employment record book or document titled Employment History Records.

The period for notifying the employees of the need to choose the format of the employment record book has been extended. According to the new rules, the employer must notify the employees through 31 October 2020.

The Decree enters into force on 23 June 2020 and will remain in force until 31 December 2020. Previously, the notification period was set to expire on 30 June 2020 in accordance with Clause 4, Part 1, Article 2 of Federal Law No. 439-FZ dated 16 December 2019.

In addition, the employer is now free to choose the employee notification method at its sole discretion. The employer must specify this method in the relevant by-law.

EMPLOYEE’S EMPLOYMENT HISTORY RECORDS

Form STD-R was approved on 01 March 2020. Instead of a paper-based employment record book, the employee choosing not to keep one will receive the Employment History Records as per Form STD-R from the employer. The Employment History Records as per the form referred to above shall be issued at the employee’s request or upon termination of his/her employment. The employer may issue the Employment History Records as per Form STD-R either in hard copy or in electronic form. The format shall be selected by the employee.

RETENTION PERIODS FOR HR RECORDS

The retention periods for corporate HR records were amended effective from 18 February 2020.

ELECTRONIC DOCUMENT MANAGEMENT

Employers are invited to take part in an experiment providing for converting HR records (e.g., employment contracts, appointment and dismissal orders, vacation schedule) in electronic format. The experiment will last through 31 March 2021.

«WORK IN RUSSIA» WEBSITE

These Rules have been adopted by the Government of the Russian Federation to deliver the government guarantees to ensure Russian citizens’ constitutional rights to work and social security against unemployment. Employers have been placed under an obligation to furnish the employment information to the Information and Analytical system: All-Russian Database of Vacancies «Work in Russia» in a timely manner. The Rules came in force starting 13 April 2020 and will remain in force until 31 December 2020.

CANCELLATION OF CHILDCARE ALLOWANCE

The Edict on cancellation of the childcare allowance of RUB 50 payable to mothers (or any other family members taking care of a child) officially employed by enterprises, institutions, and entities irrespective of legal form and servicewomen on childcare leave for children under 3 y.o. was effectively cancelled from 01 January 2020.

REGISTRATION WITH MILITARY AUTHORITIES

Starting 18 February, employers must issue a certificate as per designated form to make sure that the employee gets registered with military authorities at the place of stay upon appointment or dismissal.

FINES FOR NON-COMPLIANCE WITH MILITARY REGISTRATION REQUIREMENTS

The Code of Administrative Offences of the Russian Federation has been amended by Federal Law No. 132-FZ dated 24 April 2020 as follows: the fines for individual violations of military registration requirements were raised effective from 05 May 2020.

DRIVERS’ WORK AND REST SCHEDULE

New work and rest schedule for drivers of trucks over 3.5 tons and buses were adopted effective from 01 January 2020.

The new rules limit the time to be spent by truck and bus drivers operating the vehicles. Truck and bus drivers must have rest for at least 45 minutes per 4.5 hours of work.

FOREIGN EMPLOYEES

Foreign employees do not have to renew the documents expiring in the period from 15 March through 15 September. In particular:

  • Visa;

  • Temporary residence permit;

  • Permanent residence permit.

These temporary measures shall be in effect from 15 March to 15 September 2020.

Guarantee for employees working in areas of far north and similar territories

These temporary measures shall be in effect from 23 June 2020 to 31 December  2020.

If employees didn’t exercise the right to compensation of travel to the place of leave and back and baggage charges due to restrictive measures to prevent the spread of COVID-19, they can realize this right in 2021.
