INDEPENDENT ASSESSMENT OF QUALIFICATIONS
Federal law as of 03.07.2016 № 238-FZ “On independent assessment of qualifications”.Comes into effect on January 1, 2017.
- The procedure of independent assessment of employees’ qualification is established
- Assessment of qualifications is carried out by independent qualification assessment centers
- Employees will be able to confirm independently compliance of their qualifications with the requirements of occupational standard or qualification requirements
- Employees may pass the independent assessment of qualification at the direction and at the expense of Employer. If Employer assigns the Employees to pass the assessment, the Employer shall document the procedure of this assignment in the collective or employment agreement. Employee’s consent to go through the assessment is compulsory
- The independent assessment for compliance with the occupational standard is absolutely voluntary
- The employee’s place of employment and average salary for the time of off-the-job assessment are retained for the employee.
MICRO ENTERPRISES
Federal law as of 03.07.2016 № 348-FZ “On changes to the Labour Code of the Russian Federation in the part of aspects of labour regulation for persons working for the employers – who are the owners of small businesses, which are classified as micro enterprises”Comes into effect on January 1, 2017.
- Chapter 48.1 has been added to the Labour Code. Aspects of labour regulation for persons working for the employers – who are owners of small businesses, which are classified as micro enterprises.
- After these changes maintaining of HR records at micro enterprises is simplified. Individual entrepreneurs and companies classified as micro enterprises may not approve some internal local acts. At that all conditions and guarantees shall be included into employment agreement, which will be concluded on the standard form.
- Register of companies classified as micro enterprises will be kept by the RF Federal Tax Service.
Decree of the RF Government as of 27.08.2016 № 858 “On standard form of employment agreement, concluded between employee and employer - who is an owner of small business, which is classified as micro enterprise.
Standard form of employment agreement that shall be applied by employers, whose businesses are classified as micro enterprises and who decided to not approve the local regulatory acts, has been approved.
Standard form may also be used by other employers.
DRIVERS
Federal law as of 05.05.2014 № 132-FZ «On amendments to article 3 of the Federal law “On amendments to the Federal law “On road traffic safety” and Administrative Offences Code of the Russian Federation».A new procedure has been introduced; according to this procedure it is possible to hire a foreign citizen for the position of driver irrespective of his status only if he has Russian-style driver’s license (art. 3 of the Law as of May 7, 2013 № 92-FZ, art. 2 of the Law as of November 2, 2013 № 285-FZ). In case of violation of this requirement the company will face administrative liability (from June 1, 2017).
